New Jersey · No SR-22

New Jersey does not use the SR-22

There is no SR-22 in the MVC's forms index and no carrier files one on your behalf here. New Jersey asks you for proof directly, and bills you separately through the surcharge system.

How it works

New Jersey asks you, not your insurer

The difference is who does the filing. In an SR-22 state the carrier certifies your coverage to the DMV and tells it when the policy ends. New Jersey does neither. Restoring a licence after an uninsured-driving suspension requires you to send the MVC “a photocopy of your current NJ insurance identification card” or the declaration page of your policy. There is no SR-22 in the MVC forms index, and the uniform-act certificate sections are absent from the current compilation.

State requirement

The surcharge is the part people miss

New Jersey's real financial consequence after a DUI or an insurance conviction is the Surcharge Violation System: an annual bill from the state, running for years, entirely separate from your premium. It is not a filing fee, no insurer collects it, and no certificate ends it. People who arrive expecting an SR-22 are often braced for the wrong cost.

Timeline

Restoring a New Jersey licence

  1. 01

    Identify the suspension type

An insurance suspension, a surcharge suspension and a court suspension clear differently, and satisfying one does not satisfy another.

  2. 02

    Get proof of current coverage

The MVC wants your NJ insurance identification card or the policy declaration page. You send it, not your insurer.

  3. 03

    Deal with the surcharge separately

Surcharge arrears can hold a licence on their own. Clearing insurance does not clear them.

  4. 04

    Pay the restoration fee

A separate charge from both the surcharge and your premium, and the last step rather than the first.

"Most states" is the most common value across all 50 states, not an average. The filing fee is set by the carrier, not by the state, so there is no state figure to compare.
If you lapse

What a lapse costs in New Jersey

There is no SR-26 to be filed against you. The exposure here is the surcharge system and the suspension that follows an uninsured conviction.

Annual surcharges for years

Billed by the state after qualifying convictions, separate from your premium, and they do not stop because you are now insured.

Suspension for non-payment

Unpaid surcharges suspend the licence on their own, independently of anything to do with coverage.

Restoration is your paperwork

Nobody files on your behalf, so a missing document simply means nothing progresses until you chase it.

Another state's clock resets

If you carry another state's mandate, a lapse here can restart that state's period from zero.

No vehicle?

Moving here with an SR-22 from another state?

New Jersey will not adopt it and cannot end it. The mandate stays with the state that imposed it, counting on that state's schedule. You need a New Jersey policy from a carrier willing to keep filing the certificate into the original state, and letting it lapse can restart the period there while your New Jersey licence looks perfectly clean. One phone call establishes which carriers write that combination.

Coverage

SR-22 in Newark, Jersey City and the rest of New Jersey

The rule is the state's, so it reads the same in Newark, Jersey City, Paterson, Elizabeth, Lakewood and Edison, and everywhere else in the state. There is no city filing, no city form and no city office that changes it. What changes between drivers is the premium, and that is set against your record rather than your address.

FAQ

New Jersey SR-22 questions, answered honestly

Does New Jersey require SR-22 insurance?
No. There is no SR-22 in the New Jersey MVC forms index and no carrier files one with the MVC on your behalf. Restoration after an insurance suspension requires proof that you submit yourself.
What does the MVC accept as proof instead?
The MVC's own restoration guidance asks for a photocopy of your current New Jersey insurance identification card, or a photocopy of the declaration page of your current policy.
What is the New Jersey surcharge, and is it the same thing?
No. The Surcharge Violation System bills you annually for years after qualifying convictions such as a DUI. It is a state charge, not an insurance filing or a premium, and no certificate ends it.
Why do so many sites sell a “New Jersey SR-22”?
Because they publish all fifty states from one template. New Jersey does suspend licences and does require proof of insurance to restore them, so it resembles an SR-22 state from the outside.
I have an SR-22 from another state and I moved to New Jersey. Does it end?
No. The mandate belongs to the state that imposed it and continues on that state's schedule. You need a carrier that will keep filing into that state, and a lapse can restart the period there even though New Jersey asks nothing of you.
A court told me to provide proof of financial responsibility. Is that an SR-22?
Not in New Jersey. A court can impose its own proof condition as part of a sentence, satisfied to the court, which is separate from anything the MVC requires. Ask the court clerk exactly what form it expects.

Questions that are the same in every state, like what happens when a policy lapses, are answered on the SR-22 FAQ. What an SR-22 actually is, and is not, is on the SR-22 explainer.
